Domain Name Transfer Agreement
This Domain Name Transfer Agreement ("Agreement") is by and between Pixel Cube ("Pixel Cube") a/an individual and You, Your heirs, agents, successors and assigns ("You"), and is made effective as of the date of electronic execution. This Agreement sets forth the terms and conditions of Your use of Pixel Cube's Domain Name Transfer and represents the entire agreement between You and Pixel Cube. This Agreement sets forth the terms and conditions of transferring a registered domain name from any other Registrar TO Pixel Cube (as "Registrar"). By participating in this transaction, You acknowledge that You have read, understand and agree to be bound by all the terms and conditions of this Agreement, including our dispute policy, along with any new, different or additional terms, conditions or policies including the Universal Terms of Service which Pixel Cube may establish from time to time. Such Agreements may be found here.

In addition to transactions entered into by You on Your behalf, You also agree to be bound by the terms of this agreement for transactions entered into on Your behalf by anyone acting as Your Agent, and transactions entered into by anyone who uses the account You've established with Pixel Cube, whether or not the transactions were in Your behalf. You acknowledge that Pixel Cube's acceptance of any application made by You for services provided by Pixel Cube will take place at the Internet Corporation for Assigned Names and Numbers ("ICANN") accredited registrar's offices located in Scottsdale, Arizona, USA.

You acknowledge that Pixel Cube or its licensor is a registrar bound by an agreement between Pixel Cube or its licensor and the Internet Corporation for Assigned Names and Numbers ("ICANN"). You agree that Pixel Cube or its licensor may modify this agreement in order to comply with applicable law and the terms and conditions set forth by the Internet ICANN and/or the Registry Administrator chosen by ICANN, as well as any registration rules or policies that may be published from time to time by Pixel Cube or its licensor.

This Document will be effective upon acceptance of the Registration and Transfer agreements in Step 3 of the Online Transfer Application process.

1. Steps for Transferring Your Domain Name Registration
NOTE: Once the transfer is complete, you will be able to RENEW, MODIFY DNS, and perform other functions by logging into Your Account Manager. Complete all required information requested through the online transfer application, i.e. contact information, nameserver information, etc. Proceed through to the shopping cart and pay for your transfer(s). Update your Administrative Contact's email address at your current registrar. We will be contacting the Administrative Contact's email address for transfer approval. The transfer will only be initiated upon approval from your Administrative Contact. Once initiated, a transfer will be accepted or denied by the losing registrar within 5 days.

2. Failed or Rejected Transfer Requests
Pixel Cube may elect to accept or reject your domain name transfer application for any reason at its sole discretion. Rejections may include, but are not limited to: The current Registrar rejected the transfer. The original registration took place less than sixty (60) days prior to the transfer request. The domain name has been placed in a locked status by either the Registry or by the losing registrar. The domain was transferred to Pixel Cube less than sixty (60) days prior to the transfer request. The domain name expired but was not renewed. The domain name expired and was renewed during the forty-five (45) day grace period, and the forty-five (45) day grace period has not yet passed. The Domain Name Registrant was changed less than sixty (60) days prior to the transfer request. Any pending bankruptcy of the current domain name holder. Any dispute over the identity of the domain name holder. Any situation described in the Dispute Policy. Transfer orders over thirty (30) days old.

3. Terms for Transferring Domain Names
Upon successful transfer, Pixel Cube shall become the Registrar of Record. You will still be the Registrant of the domain -- Pixel Cube will become the Registrar of the domain name. Your registration will be automatically extended by one year. Domain name registration transfers may only be initiated once acceptance of the transfer agreement is recorded, payment is made and the Administrative contact has responded positively to our email message asking for Permission to Transfer. The email message asking for Permission to Transfer will be sent to the Domain Name(s) Administrative Contact as identified in the previous Registrar's WHO-IS database. You agree to retain a copy for Your own records of the receipt for purchase of Your domain name. The Administrative Contact will be acting on behalf of the Registrant and has legal authority to initiate this transfer request. You are responsible for updating the Administrative Contact's email as identified in the previous Registrar's WHO-IS database.

4. Transfers of Recently Renewed Domain Names
You understand that if you are transferring a domain name that has been recently renewed there is the potential that the renewal year will be lost. The renewal year will be lost if: the domain name was renewed during the forty-five (45) day grace period after the expiration date had passed; and forty-five (45) days have not yet passed since that expiration date. You understand and agree that Pixel Cube is not responsible for this lost year and that Pixel Cube will not credit that year to your domain. You will need to review the registration agreement you have with your previous registrar to determine if you are due a refund or credit for the lost year. Please contact your previous registrar if you have any questions about the lost year. You understand and agree that Pixel Cube will not intervene in the recovery of any such lost registration years that occur during the transfer of your domain name.

5. Limitation of Liability
YOU AGREE THAT Pixel Cube WILL NOT BE LIABLE FOR: ANY SUSPENSION OR LOSS OF THE DOMAIN NAME REGISTRATION IN YOUR NAME USE OF YOUR DOMAIN NAME REGISTRATION BY YOU OR OTHERS, WHETHER OR NOT AUTHORIZED BY YOU TO HAVE SUCH USE INTERRUPTION OF BUSINESS ACCESS DELAYS OR ACCESS INTERRUPTIONS TO THIS SITE OR THE WEB SITE(S) YOU ACCESS BY THE DOMAIN NAME REGISTERED IN YOUR NAME DATA NON-DELIVER, MIS-DELIVERY, CORRUPTION, DESTRUCTION OR OTHER MODIFICATION EVENTS BEYOND Pixel Cube 'S REASONABLE CONTROL THE PROCESSING OF THIS APPLICATION OF THE DISPUTE POLICY Pixel Cube WILL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING LOST PROFITS) REGARDLESS OF THE FORM OF ACTION WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), BREACH OF WARRANTIES, EITHER EXPRESS OR IMPLIED, OR OTHERWISE, EVEN IF Pixel Cube ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME STATES MAY NOT ALLOW SUCH A BROAD EXCLUSION OR LIMITATION OF LIABILITY FOR DAMAGES, AS CONTAINED HEREIN; IN SUCH STATES, OUR LIABILITY IS LIMITED TO THE FULL EXTENT PERMITTED BY LAW. IN NO EVENT SHALL Pixel Cube MAXIMUM AGGREGATE LIABILITY EXCEED THE TOTAL AMOUNT PAID BY YOU FOR REGISTRATION OF A DOMAIN NAME.

6. Indemnification
You agree to defend, indemnify, and hold harmless Pixel Cube for any loss, damages, or costs, including reasonable attorneys' fees, resulting from any third party claim, action, or demand related to the registration or use of the domain name registered in your name. This indemnification is in addition to any indemnification required of you under the Dispute Policy.

7. Data for Domain Transfer
You understand that this is a request for a domain name transfer of registrars. By acceptance of this Transfer Agreement, you are requesting that the domain name registration be transferred from the current registrar to Pixel Cube . As the current authorized Registrant of the domain name(s), you agree to authorize this transfer by notifying your Administrative contact of his/her responsibilities with respect to this transfer. You acknowledge that you and Pixel Cube have entered into a Domain Name Registration Agreement (hereinafter referred to as "Registration Agreement"). You have read, understood, and agree to be legally bound by the agreements that govern all domain names registered through Pixel Cube as found on the legal agreements page, including the Domain Name Registration Agreement ; the dispute policy ; this Agreement; any Pixel Cube policies and procedures that are or may be published from time to time by Pixel Cube , ICANN, and/or the Registry Administrator chosen by ICANN.

8. Other Venue
Agreement shall be governed by, and construed and enforced in accordance with, the internal laws of the State of Arizona applicable to contracts made and to be performed wholly therein, without regard to principles of conflicts of laws. Venue for any dispute shall be in Phoenix, Arizona and each party expressly consents in the jurisdiction of the federal and state courts located in Maricopa County, Arizona.

Notices
All notices and other communications under this Agreement shall be in writing to Domain Transfer Dept, 14455 North Hayden Rd., Suite 219, Scottsdale, AZ, 85260.

Entire Agreement
This Agreement, together with all Exhibits hereto, constitutes the entire understanding and agreement of the parties with respect to its subject matter, and supersedes all prior understandings and agreements, whether written or oral, with respect to such subject matter. No waiver, modification or amendment of any provision of this Agreement will be effective unless it is in writing and signed by the parties without limiting the foregoing, no waiver shall be implied by or deemed to have occurred on account of any course of conduct or dealing. No additional or different terms provided in any purchase order or acceptance or similar document shall be binding unless executed by authorized representatives of both parties

Before you purchase your domain name you need to do some domain homework.
Get your domain name first before you start your new business or website.
Many times people start a brand new business by picking out and establishing the business name, then they attempt to buy a domain name. The new business owners soon find out that every variation of the business name is taken and they are not sure what domain name to use.
Microsoft made a huge mistake when they spent millions marketing their new Zune MP3 Player. They didn’t secure the domain name zune.com and as of this writing the domain zune.com is still under someone else’s name with an under construction sign. Microsoft had purchased the zune.net domain name after the Zune name had been released. This was a huge blunder for the Microsoft marketing team not to secure the zune.com domain name before marketing their brand name.
Naming a website after its domain name can also be very important; when people think of your website, they'll think of it by the name. A good example of this is amazon.com; so if your business name is also your URL, the customer will automatically know where to go.
If you have already spent a lot time and money to establish your business name and you didn’t purchase a domain name. You can play around with some variations to try to get an easy name. If you fine that your business name is taken in every way thinkable, you can:
Check the whois information for the domain name you are interested in and contact the current owner listed to see if they're willing to sell it.
Another option is to search the Internet for a company that specialized in deleted domains. Each day thousands of domains are deleted and are made available for purchase. Many times people may forget to renew the domain or they simply go out of business; the domains are then deleted from the current owner and allowed to be purchased again. This can be a very good way to get the right domain name by using the deleted domains data base to search for certain keywords important for your business. A name that you didn’t even think of may show up as deleted and be the one name that will work.
Your domain name should be short, easy to say and spell.
Domain names can be of any length up to 67 characters. Someone actually bought the domain name shown below and let it go back. I wonder why???

Shorter domain names are much better, especially for people who have to type them in. There is less chance for a typo when they are shorter. Premium domains with less than 8 characters are more desirable and very hard to find. You may have to put together some word combinations to come up with a good domain name. I would try to keep the name under 16 characters if at all possible.
Type out the domain name you are interested in buying – take a good look at it and say it out loud. Get friends to look at it and give their advice at what they first see.
Does it spell something that could be offensive? www.somethingassociates.com
Is it spelled correctly or are you trying to spell some word another way? www.gotravlers.com instead of www.gotravelers.com Can you easily distinguish the words or does the domain name make other confusing words?Does it have 2 or 3 of the same letters together? www.abbotttech.comDoes it sound OK? Is it easy to understand over the phone? Can the domain name be spelled easily by the average person? www.rockefellermontessori.comKeep in mind that many times you will have to spell out your domain name to people-- will certain letters sound like other letters?...such as… the s and f sound the same; same goes for the n and m; z and b, and so on.
Prefixes
Many websites use prefixes in their main domain name such as i and e. The i is most commonly for Internet, e for electronic. Many other prefixes such as all, my, best, pro, go, buy, best, and many more can be used.
These prefixes mentioned above should only be used when there is absolutely no hope for finding a good domain name.
Hyphenated or Numbered Domain Names?
Many people forget to type in the hyphen when typing in a domain name. It can be hard to say when giving the domain name out. It would be easier to say littleredschoolhouse.com instead of little hyphen/dash red hyphen/dash school hyphen/dash house .com.
Most of the good domains are taken and you may have to take a domain that has a hyphen in it to get the domain name you want. I would try to avoid the hyphenated names if possible.
Domains which contain numbers have some problems in that you will have to explain that it is a number 4 instead of the word for or four. 4salesonline.com is a good example of the confusion in telling the domain name to someone.
Of course if you owned 500.com or 5555.com these would be great names that are worth a lot of money and easy to remember. All of these good domains are already taken and very hard to find even on the secondary market. 
A domain name like 94529875.com would be hard for someone to remember.
COM, ORG, NET, etc?
Typically most businesses use .com domain names. Most .net domain names have been used by Internet organizations and .org is frequently used by non-profit organizations.
Most people have .com on the brain, and when typing a domain name in, they will almost always assume it's a .com domain. Dot com’s are the most sought after.
What does .com, .net and .org stand for?
.com represents companies or for profit organizations, it is also the most common extension for domain names. Most personal web sites also use this extension
.net generally represents Internet Service Providers and other organizations
.org represents non-profit organizations or groups
.info stands for .Information and is generally for information type sites but not limited to that type
.biz domains are used for businesses sites
.us stands for United States and can be used for any type of site
.ws means 'website' and can be used for many different types of websites
Though these are general guidelines, you may use any of these extensions when registering a domain name. If you want to be make sure no one else can benefit from your domain name, it's a good idea to register all three variations of your domain name. 
Domain Name Status Codes 
ACTIVE: The registry sets this status. The domain can be modified by the registrar. The domain can be renewed. The domain will be included in the zone if the domain has been delegated to at least one name server.
REGISTRY-LOCK: The registry sets this status. The domain can not be modified or deleted by the registrar. The registry must remove the REGISTRY-LOCK status for the registrar to modify the domain. The domain can be renewed. The domain will be included in the zone if the domain has been delegated to at least one name server.
REGISTRAR-LOCK: The sponsoring registrar sets this status. The domain can not be modified or deleted. The registrar must remove REGISTRAR-LOCK status to modify the domain. The domain can be renewed. The domain will be included in the zone.
REGISTRY-HOLD: The registry sets this status. The domain can not be modified or deleted by the registrar. The registry must remove the REGISTRY-HOLD status for the registrar to modify the domain. The domain can be renewed. The domain will not be included in the zone.
REGISTRAR-HOLD: The sponsoring registrar sets this status. The domain can not be modified or deleted. The registrar must remove REGISTRAR-HOLD status to modify the domain. The domain can be renewed. The domain will not be included in the zone.
REDEMPTIONPERIOD: The registry sets this status when a registrar requests that the domain name be deleted from the registry and the domain has been registered for more than 5 calendar days (if the delete request is received within 5 days of initial domain registration it will instead be deleted immediately). The domain will not be included in the zone. The domain can not be modified or purged; it can only be restored. Any other registrar requests to modify or otherwise update the domain will be rejected. The domain will be held in this status for a maximum of 30 calendar days.
PENDINGRESTORE: The registry sets this status after a registrar requests restoration of a domain that is in REDEMPTIONPERIOD status. The domain will be included in the zone. Registrar requests to modify or otherwise update the domain will be rejected. The domain will be held in this status while the registry waits for the registrar to provide required restoration documentation. If the registrar fails to provide documentation to the registry within 7 calendar days to confirm the restoration request, the domain will revert to REDEMPTIONPERIOD status. The domain status will be set to ACTIVE only if the registrar provides documentation to the registry within 7 calendar days to confirm the restoration request.
PENDINGDELETE: The registry sets this status after a domain has been set in REDEMPTIONPERIOD status and the domain has not been restored by the registrar. The domain will not be included in the zone. Once in this status all registrar requests to modify or otherwise update the domain will be rejected. The domain will be purged from the registry database after being in this status for 5 calendar days.
